No court activity

Opposite party filed for a first appeal in the Jharkhand High Court. It was allegedly dragged by the opposite party for over 3 years which seems to be deliberate tactics to me.

The opposite party/court sent a notice with the name of the person who was no longer alive.
Post which the court was notified of the notice being sent from a person no longer alive. The court seems to have proceeded with name substitution and notice was sent by the court which had a date after the hearing/court date.

Since then the court is silent with no activity after it ordered for lower court records, it has been almost a year and there is no activity.

The date as per the court website marks the next date of hearing as 2 years ago. What is the best approach to ensure that the case moves in a timely fashion to get justice served?

@ TiredofSlowJustice,

Nothing can be presumed on the basis of "no" facts / query posted.

Consult your lawyer if you have faith in him / her other change him/ her immediately.

The advocate that is handling the case at HC knows ways and means that are possible to expedite the case.

Have the High Court  stayed  the Judgment? Have you received Notice from the High Court?
