I had purchased a plot as per my choice from a reputed Promotor and Builder. He issued a cash receipt for the consideration amount. There is no other document and no agreement was executed . When I wrote to him for executing the sale Deed, he gave me,in exchange another plot of his choice and in turn forced me to accept the same.
He executed Development Rights and POA in my favour and referred me as DEVELOPER/PROMOTOR/BUILDER in the agreement,whereas i am a housewife. He did not consult me as regards to the property discripttion in the agreement and when I pointed out that this property does not have entry to the plot. He said I will do the needful at a later date but as of now you take the possession. I had to take the possession as there was fear of losing the property.
This plot is 9000 sq ft and he has given me 3000 sq ft named as PLOT 14A and 3000sq ft to another person and named it as PLOT 14B .Plot 14B has a separate entry which cannot be used by me. I am not sure wheather the remaining 3000 sq ft is sold or unsold. He has sold me a plot without an enterance.
My question is can I proceed legally against him as I have signed the D.R and POA document.
Your advise on this.
