NOMINATION

My wife aged 75 and my elder son aged about 50 have joinly executed an "Agreement for Sale" with a Building

Developer  in PUNE.  My wife wishes to give full rights of OWNERSHIP of the said Apartment to my elder son ;

The Apartments  Building is complete in all respects, and  has been occupied by all the "Owners" but the

Conveyance  Deeds  of all the occupants is yet not done by the Builder.  Proposed  Society  of  Occupants of

these  APARTMENTS 

has  been  formed  and  Permamnent  Maintenance  Deposit  of  Rs. One Lakh has been collected from

each

of the occupants and monthly  maintenance of Rs.2000/- is being collected every month.

My  Question :  How  can  this  Apartment ( owned by my wife )  be legally  transferred  SOLELY  TO  OUR 

ELDER  SON  ?    Will   I  get  a  legal  guidance ?  Due  to  some  difficulties,  a  "WILL"  cannot  be  executed

immediately.  Please  advise .

well if will is not the option and your wife and have jointly executed agreement to sale then your wife by making relinqueshment deed in the name of your elder son can transfer hsi ownership rights do not forget to mention rights obtained in agreement to sell in the relinqueshment deed

Relinqueshment deed requires no registration fee qua market value as applicable to sale deed and gift deed

hope this will be suffice
