Paghdi flat in mumbai

1.

I have a PAGHADI flat in Mumbai.

The flat was vacant for 20 years.

The building has gone for REDEVELOPMENT.

Can the landlord claim the flat now.

 

2.

I have a flat in a PAGHDI building in Mumbai.

The building has gone for redevelopment.

The Tenant, the landlord and the builder has to sign the "DEVELOPMENT AGREEMENT".

If the landlord refuses to sign my agreement what are my options.

You can approach court with a suit for permanent injunction against both to stay the process of redevelopment on the basis of your tenancy and seek direction to the builder to include you in the redevelopment project as per law.

If the bu.ilder refuses to sign the development agreement, do not handover possession and seek opinion and advise of a local prudent lawyer for legal options

  • In case of redevelopment, the tenant can be a co-promoter.
  • The tenant can be a co-owner of the premises but not of the land.

Please help me with the following.

I have a PAGHDI flat in Mumbai.

The flat was vacant for twenty years.

The building has now gone for REDEVELOPMENT.

Out of 34 tenants "REDEVELOPMENT AGREEMENT" is done for 30 tenantes.

The "REDEVELOPMENT AGREEMENT" is pending for 4 members including for my flats.

Can the LANDLORD claim the flat.

You can give a notice to the developer to include your name in the list of tenants by producing the documentary evidence to prove your tenancy, in the absence of your swift action the owner may take an advantage over the situation and grab yoiur property
