Respected seniors,
My friend's grandfather has died 5 years back. He has 2 sons and one married daughter.
All the property (at native place in Maharashtra) is still on the name of grandfather. My friends uncle (the elder son) is enjoying all the benefits from this property. My friends father are staying in Mumbai (job).
My friends fathter tried to convince his elder brother for the partition of the said property, but the elder brother said that he will not give any property to him.
Now My friends father want to file a case in the court for his share in the ancestral property (partition of property).
In which court he should file a case - in the local taluka level court or district court or directly he can approach the High court? please guide us regarding the jurisdiction for filing the case?
OR is there any other option by which he can get this issue solved.
