what period is TIME BARRED for admitting a case in court ?

Second, A cheque is given 4 years back with out date .CAN IT BE ADMISSIBLE UNDER SEC 138 OF NI ACT ?

Cheuqe is time barred as because of out date.Cheque is valid for six months.

You have to prove it in a court and raise the issue in the court to take defence in your favor.

Thanks.But cheque is given without writing date ? four years back

Then it can be used by banks or any person.

Its a very big mistake as one can fillup the date and files a 138 case.
