Problem with building contractor

I would like to get a legal opinion regarding the following issue.  Thanks in advance to all who take time to read and reply for this


We are building a house measuring 2820 Sq.ft and we hired a building contractor for construction. Since we know him for the past 5 years, we didn't sign any written agreement and had only verbal agreement that he would be doing construction at a rate of 1650 rs/sq.ft for the ground floor and 1600 rs/sq.ft for first floor. Now the construction has come to the finishing stage and the contractor has received Rs.37,15,000 till date.

As we were skeptical about his work, we asked for total estimate. He included all the extensions such as sun shades, outside staircase etc., and increased the area to 2972 Sq.ft and gave us bill for Rs.48,00,000. We agreed upon to that as well. But he asked for another Rs.1,50,000 to continue the construction. Since, there are many works pending like granite flooring, sanitary fittings, plumbing, carpentry, electrical works etc., we couldn't trust the contractor that he would be completing all the works with the rest of the amount which equals Rs.10,50,000.

So we said, we would buy all the materials and asked the contractor to bear the labor charges which we would settle at the end. He didn't agree to it and kept on asking Rs.150000. So we said we can end up our relationship and we would do the rest of the works of our own for which he says, still we needs to pay him rs.2,00,000 and only then he would leave. We said, already we have paid in excess and so we cannot pay anymore. Contractor said, he would be dealing legally and we politely said, do whatever you could and we would reply in the court.


Here the available documents available with us,

1. We are maintaining an 80 pages note where contractor would give his signature after receiving money every time.

2. During the start of the construction, contractor has given us a bill for Rs.45,00,000 with all the work related details. All the material bills are available with the contractor.

My question is,

Will all these documents be sufficient to submit in the court to prove the justice from our side?.
