Property issue

Hi,

 

 I have bought 49 square yard land in palwal.

Now the uncle of owner has filed a case against me and owner that "If there is buyer avaialbe in family itself), then why the owner has sold the land to me.

 

Please let me know , how long the case can go? and How much changes of my winning here?

 

The case of owner and his uncle is "saini(mali) hindu".

The Suit his uncle is filed is known as 'pre-emption' suit, and this is possible only when they both were joint owners of the property. If the property was the sole/absolute property of the owner & uncle had no share therein - he cannot challenge the sale.

Hi Sir,

Thanks for your valuable advise. I have a small query now. When we transferred our property then we have transferred more than what was actually available. i.e. we had 49 sq. yard land each, but we transferred 55 yard to each other , will this create problem in future.

I asked the local lawyer about this, he said, "you just have contributed to goverment income while giving more money for registry, so it will not be an issue.

 

Please guide.
