Property tax for new building

Hello All,

I would like to seek your opinion regarding property tax payment as per society by laws for Maharashtra state for newly constructed building. We received OC for flat in Mumbai around 20/06/2022 for the building and the clubbed property tax for period 2022-23 and 2023-24 has been recently handed over to society for payment on 12/02/2024 whearas the due date was 03/02/2024 so likely penalty of 2% to be imposed by BMC. The possession were given for individual flats on start of 2023 and society handover was done around the end of 2023. Now I have the below queries -

1. Is Builder liable to pay property tax till possession or society handover?

2. Is Builder liable to pay penalty?

Builder has likely delayed sending the bill to society inorder to create panic  of being penalised by BMC so that member will pay the bills without any investigation or research.

Please suggest rules as per law.

1. It becomes the duty of the buyer to pay the property tax from the date of registration of sale deed on his name.

2. Whoever is liable to pay the tax shall have to pay penalty for delay in payment of property tax.
