Query on maintenance amount

 

Dear Experts,

I'm confused with the maintenance amount on divorce decree.As I read from this forum it is predicted that it would be near about 20%-30% of a person's take home salary.But if we go by the Planning Commission's recent calculation Rs 28.65 per capita per day for cities and Rs 22.42 for rural areas is enough for daily living.

 

My question here is that why the calculation method of courts & indian govt.are different?I agree that due to child's custody it may be vary but in case of no kids why amount doesn't match with the govt.calculation?

 

Please make me understand how it is calculated in court.

In india there no set formula as such for the courts to decide . Had there been a set formula than everybody would have predicted your maintanence  and than you could have argued with the judge :)

I guess the Government calculations are always poor... A bunch of animated characaters who know Nothing....
