I stay in rented house since June,2004. We are prompt rent payers. It was in 2008 my flat owner with his wife were caugh red handed by ACB and Central crime branch. May owner after landing me the flat was still staying in same city as both wife and husband had knee problem and could not clime the stair though the flat is only on first floor. My wife was the bail guarantor for them. We had also helped them financially then as it was promised by them that they will sell the flat to us when ever they need the money. We could not buy the flat then as all the document and bank account of my flat owner were seized. And I too was advised mt my lawyer not to get involved in any legal transaction with them then as the case was with CBI and any day we too could be drag by them in scrutiny. So thought to give them only financial help. The only mistake we did was we did not make any documental evidence of that. It was also agreed that as they may need money for there case, we will pay them rent regularly, when ever they demand. Has the rent was only Rs 3500/- then they also asked us to pay money once in two or three month, on their demand, which we did when ever they asked. Since couple of years they are staying in Rajumundry in Andhra Pradesh with their son as the case is in Vizag court. Now the rent is Rs 5500/- and Rs 1000/- is building maintance. We deposit the amount in bank evertime we are asked to do by the owner (once in two or three months). We have bank receipts of the same. Now suddenly my owner as asked to handover the flat to him and he is denying of the two lakhs rupees we gave them. We have understand that he is planning to sell the flat out with present market rate to someone outside. Where as it was fixed at rs 16.5 lacs in 2008 between us. The present rate of flate would be around Rs.30 lacs.
My lawyer is no more and I am in fix whom to ask about this as people will laugh at me that how have I given 2 lac rupees without any document evidence. I have not paid him rent for last two months as he did not demand for it and now he as threatened me to go to court for non payment of rent. We never had any rent receipt collected from him nor he ever mentioned of it. It was all on good faith for all these years. In fact we had also invested on renovation of flat of course with his permission in 2010 as even then he said its your flat and you could any thing you want to do. Now he is take back his words.
Please guide us, What ground should we take. This man was caught with his wife taking bribe. Both the wife and husband were in same branch with Govt.
