Residents welfare association compensation

My car got damaged by the society apartment main iron gate and I reported that to the then president of our association. He replied and said that the hinges of the door were broken due to which the door hit my car and damaged my car door. He accepted to take care of the damages and kept me waiting for months. Later he came back and said the other members saw the CCTV footage and believe that no compensation should be given. I would like to challenge this legally and want to know what are my options. The association has changed and he and other members are no longer in power, how does this impact my case?

Dear Vikas

You can approach the civil court with reference to Negligence under Law of Torts and claim monetary damages. Since the soceity owed you a duty of care since you're a resident of the society, and they breached it by not repairing the hinges of the gate due to which a damage was caused to you, this meets the essentials of Negligence. Therefore you'll be able to take the issue to civil court
