shrikant v. sathe (retired)     28 March 2020

Shut down of essential commodity private shop

Sir,

We all know that there is a strict warning not to get outside of your home till 14 April 2020. But there is a exception given  for purchasing vegetables and grocessary. Some of the grossary shops are closed ddue to corona virus. But as our MhaharashtrC.M. told that all grocessary shops will be opened for 24 hours .What action  government will take  against those shop keepers who have  closed their shops ? So there is a long queue in other shops for purchasing grocessary without keeping a distance? Does the government cancell their lisence?

Either to continue business or not depends on the individual and he is at liberty in taking his own precautions. The opening of a shop depends on several factors. Against the present background, no one can compel and Govt should only publish the list of such shops that are willing to observe their orders and upload them in their websites.

T. Kalaiselvan, Advocate (Advocate)     30 March 2020

There is no compulsion on the shop keepers who do not want to open their shops.

The government has announced that the grocery shops may be kept open, but it cannot force a shopkeeper to open his shop and get affected by dreaded disease.

The shop keeper may approach court to get an order of injunction against this order.

The government can keep its own sources open to maintain the supply of essentials
