Validity of stamp papers

 

Hello Experts and Seniors -

Is any validity period for stamp paper purchased but not executed?

 

Q. what is the validity period of the stamp paper on which contents of the Conveyance deed has been typed but not yet signed?

 

Details of Stamp Papers-

Purpose- Conveyance Deed

Property- Commercial Shop

State-    Haryana

Execution- Land Authority has not been signature & stamping on conveyance deed.

Vendor- Land Authority (HUDA)

Vendee- A, B, C, & D

Validity of the stamp paper is 3 years from the date of purchase

It is validy for three years from the date of purchase as mentioned in stamp paper. you may return the same to state tresure upon expiry of said period of three years and get the amount paid on refunded.

As noted from Supreme Court Judgement the Valadity for selling Stamp Paper is Six Months , i.e. within 6 months it can be sold but there is no expiry of Stamp Paper .

Indian Stamp Act 1899 does not say anything about use of the stamp paper.  Hence, there is no expiry date of the stamp papers.  However,  Section 54 says that for seeking refund, the stamp papers have to be surrendered within six months from date of purchase.

Thanks for the quick response.

The issue is what is the validity of the documents which got registered after 4 years of the purchase of the Stamp Papers though executed within six months by both the parties.

Whether the delay in the registration is fetal and invalidate the Conveyance DEED?

If so what is the remedy?

Validity of the stamp paper has nothing to with Registration of Conveyance deed.  Registration is a separate process and would be governed by the rules of respective state.
