In a recent Delhi HC judgement, the court has decided that in case of conviction, convicts need to file an affidavit disclosing their assets, income and expenditure in order to help trial courts to decide compensation payable to victim. Moreover, Delhi State Legal State Authority (DSLSA) shall file VIR in all criminal cases after summary of enquiry.

If in case, the accused does not have the capacity to pay the compensation, the Court has stated that DSLSA shall award compensation under Section 357A CrPC, from the Victim Compensation Fund under the Delhi Victims Compensation Scheme, 2018.
