Bride discovers 'husband' is a woman

 

An Indian woman lived with her 'husband' for a year before finally discovering that 'he' was really a 'she'.

Minati Khatua, 26, of Rourkela, says she and her family were completely taken in by Sitakant Routray, 28.

"He had impressed everyone in my family and they willingly agreed to our marriage," she said.

As is traditional in India, Sitakant received a substantial dowry including an Indica car, gold ornaments and more than £350 in cash.

But Minati grew suspicious after the wedding when Sitakant avoided any physical contact on the pretext of a religious vow.

"I would try hard to find out and confirm his gender but failed repeatedly," she told the Calcutta Telegraph.

"However, one day I managed to force open the bathroom door when he was having a bath. My worst fears came true. He was a woman."

Inspector Jyotirmaya Hota confirmed that police were investigating the case.

now Billion dollar question is

1. Can she sue female husband  under DV act

2. Can she sue female husband under 498a.

I think DV Act and 498a are not applicable here. Instances of cruelity are not present in the outline as hereinabove.

 

However, FRAUD is certainly to a very high degree and to an extent of criminal liability as well as compensation in civil law.

The she may have commitated this for dowry. Such an inciident happens in such a thick;y populated big country.

 Roshni, as usual you have come out with a very interesting matrimonial issues and perhaps the first of its kind in India. In one of the Intenational Conference in New Delhi, such issues was discussed on s*x operation of the spouse that goes s*x change and conflicts of Law. But your case is indeed not only strange but very interesting criminal jurisprudence. I am of the strong convictions that it is not only matrimonial Offence but a pure criminal case of cheating and will invite even civil liability as enumerated by the learned members.
