kindly cite me the judgment of SC upon 125 Crpc that at initial stage Maintenance will be awarded to the wife with immediate relief including the litigation expenses and court is bound to provide the same.

The Supreme Court has recently, in the matter of Rajnesh v. Neha & Anr. inter alia, framed guidelines on certain aspects about payment of maintenance in matrimonial disputes ("Guidelines").

Hi,

The maintenance payable to a wife during the pendency of proceedings to meet her litigation expenses is known as Maintenance Pendente Lite.  This is provided under section 24 of the Hindu Marriage Act, 1955 (HMA).  The quantum of such maintenance depends upon the factors mentioned in the section.  

This has also been upheld time and again by various courts after giving due regards to the conditions laid down in section 24.  

Following are some of the cases where various High Courts have upheld the payment of interim maintenance to meet litogations expenses.
