Yes, she can always file new case for maintenance under section 125 Cr.P.C as the first case got dismissed for non-appearance of the party and her counsel but was not dismissed on merits. More so second petition for maintenance is always open if the wife at that point of time is unable to maintain herself and has no income or financial means for herself.
