304(b)- cancellation of gift - no consent of mine

 

As case of 304(B) is booked against me and my family some 5 years .

while gathering the evidence we found that house which is gifted to me by deceased's father is cancelled some 3 years ago without my knowledge and it is mortgaged in a private finance company.

while we don't have any desire for their property,

is there any way we can use this in getting out of 304(B)?

Does filling a criminal case or civil case against them for cancellation and mortgage will create any problems for us in 304(B) ? What will be consequences? I want to only use it only for getting into terms

1. Who cancelled that gift?

2. If the property was gifted and duly registered in your name, subsequent sale is invalid and you should take appropriate legal actions. However, if the property was gifted or registered in the name of your wife, you should be vigil and not initiate any action at all.
