The limitation for filing criminal complaint is six months, if the offence is punishable with fine only; one year, if the offence is punishable with imprisonment for a term not exceeding one year; three years, if the offence is punishable with imprisonment for a term exceeding one year but not exceeding three years.

Under Section 468 oF CrPC

When the imprisonment “for the offence” does not exceed one year, the period “of limitation” is one year; When the minimum sentence “for the offence” is one year and the maximum is three years then the period of limitation will be three years
