498 a

Sir,

we got married in 2009 my wife filled 498a 406 on basis of mental harassment and toruture  in 2014 march we are leaving separately since march 2014 we applied for AB and got the same in september 2014 now nothing has moved since then we havent seen my child since then i dont understand what to do lawyer says to wait and see what the wife family do next my question is can we put any case or request to court for meeting my child or sougthing out the matter out of court.

please guid , suggest  what to do now.

 

please help

You have to file a child custody case,no doubt your request may not be acceded to by the court,but you can file an IA  seeking visitation rights to visit your child on some specified period or at a frequent interval.

Please apply for speedy trial on priority and force her to face the trial. Else the case will drag for life long.

Thank you sir for the reply, but i wanted to know since i have got bail and her claims are not accepted can i file case against her parents for making my life miserable seperating me from my wife and child i know her parents are behind what has happened they want her to settle abroad and they want me to leave my parents and go along with her. Her parents are recreating there past in my present and future since her father left his parents housefor his wife and all that crap she also feels like that only that my father will throw me out of there house.

i love my family my wife and child also are there any other ways out of court ngos to settle such one sided matters please guide

You better file Divorce Petition claiming divorce u/s.13[1][ia] and custody of the chld u/s.26 alternativrly for access.
