The facts are defacto complainant completed her evidence in 8 years. Following which, there were 4 PWs including I/O, but none appeared on behalf of prosecution in spite of several summons and warrants. The evidence of prosecution is closed. A 340 application is also lying in court undisposed. At this stage, can the accused pray for termination/acquittal

The parties can proceed further if the evidence of the prosecution is closed. Why340 petition?

The 340 appllication is for giving false evidence, suppression and fabrication of facts, and gross contradictions in FIR, examination-in-chief and x-exam of PW-1. Question is whether it is possible to take any step from the side of the defence.
