Dear Sir/Madam Please advise, My Uncle has traped in a ACB Case in 07-12-2012 in Nellore,Andhra Pradesh. He has been Suspended and later re-instated into services, he has been convicted by lower court on June 30th 2015. He applied for high court and the case has been accepted by high court On August 2015 by suspending the lower court sentence however he has been dismissed from service post the lower court conviction on Aug 2015. Unfortunately he died in January-03-2017 while the case is pending in high court we would seek your kind advice on the following accepts
Please clarify on the subjects in the above case what are the entitlements the legalhair would receive either the case stands abated wheter the suspension an dismissal period will be treated as the service Etc.

on the date of death the sentence was suspended and he was in service. Is it true?

Dismissal period will not be treated as the service.

The legal heirs of the deceased Government servant should approach the High Court and seek the leave to proceed with the appeal.

Sir/Madam is there any chance to get benifits like Job/Pention to the legal heir he served in the Department 27 years without any remarks in SR and he had best Employee award from the government but unfortunately he met this ACB ride. He was the first person in promotion list when he was in service. Because of this ACB ride he disturbed mentally it causes his death. Now his family facing so many struggles economically and mentally please help them by suggesting the steps what we have to take please

The deceased Government servant has a chance of getting the benfits if they pusue the Appeal in the High Court and succeed.
