Ad-hoc service pay protection / increment

Sir, myself appointed on ad-hoc basis in the post of Lab Assistant in the year 1999 in the scale of pay of pay of Rs.4000-100-6000 for a period of 3months and 6 moths my ad-hoc service expires on 31.01.2000, during my ad-hoc service my basic pay was fixed for an amount of Rs.4000/- in the mean time during Jan., 2000 I was selected as LGC in the scale of pay of Rs.3050-4590 and I reported for duty on 3.2.2000. Consequenty to my reporting for duty in the post of LGC my pay was lowered down to Rs.3050/- . In order to have pay protection of ad-hoc service I had represented A & N Admn. quoting Apex court order that ad-hoc service is counted for pay fixation but my request was turn down by A & N Admn. I have gone through latest DOPT OM that broken spells of ad-hoc promotion is counted for increment under FR26. Now, my question is whether the broken spells of ad-hoc appointment will count towards increment and whether myself eligible for pay protection or not.
