Adverse Possession- Claiming Of.

    Respected Learned Friends,  I would like to know if a party ,with out getting a favourable decree in the suit for declaration from the apprapriate Court  can have a claim of adverse possession over a certain property and sell it to the intending purchaser. Kindly furnnish the details.

claim of adverse possession doesnot require a decree from any court. Right vest in the occoupier of the property by fullfilling the requirements of adverse possession i.e. undisputed possession of 12 years against the consent of owner.

He can sell it to intending purchaser after amking known to the Purchaser his status and right and in the property.

12 years period of limitation only applicable for private property in case of government property there should be 30 years possession
