Hi brother, The basic needs to be fulfilled. There is no harm in earning something from private sector.

Dear Sudhir sir,

I am again posting my query.

I was working in a central PSU. there i worked 2.5 years, due to some issue the company forcefully dispensed my service one month ago without any notice.

Now the matter is pending before honorable high-court.

Now i am unemployed, can i do any other private job till the judgment?.

Please advice.

Regards,

Keep evidence of all payouts from private employment, e.g; salary slips,Form16, bank transfers etc

Yes, you can join any job as it is a matter of your livelihood. But I am afraid you will not get any backwages for the period you will remain gainfully employed.

I am not afraid that the Presiding Officer will not pass any order of reinstatement with all consequential/back wages.

Such order shall be based on merits of the case.

The award may be reduced by the amounts earned from private employment.

My view is open to correction.

I think the court will pass order of reinstatement but not back wages if you are employed elsewhere.

Inj such case, backwages if at all granted, if at any reinstatement is there will be rescrcted to the extent of income made during dismissal.

Till not reinstated, you have no restriction to do any job, while unemployed.
