Aggrieved by the order of district magistrate

Aggrieved by the order of District Magistrate passed under Section 16 (1) of the Telegraph Act, whether revisable under the Criminal procedure Code. Is it amenable to criminal appeal or Revison?

The answer is emphatic "NO". It is true that District Magistrate finds expression in CrPc, but it does not mean that District Magistrate is a ciminal court. Criminal Court is not defined in CrPc.and all District Magistrate can not be equated with criminal Court, Accordingly order of District Magistrate under TA is not amenable to criminal revision.

There is no scope of a criminal appeal. You need to approach a civil court.
