Respected sir/mam, will u plz guide me about alimony/mainetenance arears. as i m living seperately since last 4 years(due to ill behaviour of hubby) and 3.5 yrs daughter is also with me, from her birth. now m filing maintennce case. will the maintannce of child is from current date or the date of her birth?

There will be 2 allimony one interim and the other final.Interim alimony will be from the date of filing the maintainace petetion.

Please see Section 125 (2) of CrPC which clearly states that, Any Such allowance for the maintenance or interim maintenance and expenses for proceeding shall be payable from the date of the order, or, if so ordered, from the date of the application for maintenance or interim maintenance and expenses of proceeding, as the case may be.
