Myself and cousin has common ancestor house at Maharashtra. The house build up on two plots, one plot belongs to me having sqm area 200 and other plot having sqm area 170 which belongs to my cousin. Ofcourse the major portion of house is build up on my plot.
As per partition deed, it is mentioned that southern block of house belongs to me and northern belongs to my cousin, There is no area mentioned in the deed.
I want to sale my plot , but my cousing went to court and court given stay on my sale.
Please advice if I am eligible for the area as mentioned in nazul record of the plot (200 sqm) or I am eligible for 50% of house area as mentioned in the deed. But please notice that in the deed no area is mentioned.
