Appeal personal exemption

Dear experts Based on Supreme courts latest judgements in Rajesh Sharma vs State of Up, it is mentioned that "Personal appearance of all family members and particularly outstation members may not be required and the trial court ought to grant exemption from personal appearance or permit appearance by video conferencing without adversely affecting progress of the trial." Trial court denied exemption to family members in January this year. Is it possible to goto high court after these many months have passed or should a fresh application be filed in the court. Appreciate your input to this. Also my sincere thanks for all the help I received from this forum. Thank you Kundan Lal
