Applicability of benami act prior to 1988

There is a deed happened in 1960s & we are process of challenging the transaction through Benami Transactions Prohibition Act 1988.

Since the Benami Transactions Prohibition Act came into picture in 1988, Can the property in question come under the Act's purview ?

Yes the Act can be applied for cases where the property was transferred prior to the date the Act became the law. The Act itself provides that no property can be held in Benami names after the effective date. So even if the property deal had occurred earlier, it should have been now transferred to the rightful owner.
