hi there everbody my learned friends
i have a case in which five of four persons have been arrested by the police and are slapped with charges u/s 399 &402 of IPC the case is in crime stage now whether magistrate is empowered to grant of bail in cognisable offence or any court on the subject (whether bail is granted during crime stage in a cognisable offence) u/s 399 and 402 of IPC any rulings please

Sir,
it is very easy to get bail only preparation of comitting docoity is not sustainable because when the police have come to spot that time the accused not trying to escape from the spot then the charges levied against them u/s 399 is not maintainable because there is not rescue fromthe accused side this point is rallyhelp to you to acquittel of your client and regarding citation defenetly i will provide you one for recently SC judgmetn there i will send you shortly. my no: 09481559648
