My house will go for e-auction as neither me nor my wife is depositing EMI due to matrimonial disputes...house is in Joint name.
House market Value 70Lacs
Remaining Loan amount : 25 Lacs
My investment share in property : 70%
Wife investment share in property : 30 %
My question is if the house sells at 60 lakhs , will the remaining 35lakhs will be deposited in Joint account or will be given equally in our respective accounts?
Is there any way i can get court order to instruct bank to deposit the whole remaining amount in court or distribute the amount as per investment %.
If i need to file a suit for same plz guide me when and where i need to file the suit. Will bank also become party in that suit.
Currently its just 2 defaults of EMI....Bank has not given any official notice of auction yet....
Kindly clarify...lot of hard earned money in the house......I am OK if house is auctioned as wife is not ready for any compromise and only intention is to grab the whole money from house selling as alimony......need to thwart her all illegal demands.
