Blackmailing in social media reg.

Respected Sirs,

                  Few days back my brother has received 2 photos  (brother

kissing a girl and sleeping with that girl) from his brother in law

through his Whatsapp.

                   Below the photos his brother in law messaged as follows:

      " Please watch the photos.   Ask your sister to give me divorce

         Otherwise i will send these photos wherever necessary"

                   Divorce case between his Sister and Brother in law was in

favour of his sister and the Court ordered to stay together in the RCR case.

                  My brother is a Bachelor.

                  Please clarify:

                 a) whether the act of the Brother in law in the whatsapp 

                      amounts to Blackmail?

                 b) whether my Brother can send a legal notice/ file a 

                      complaint with the Police?

Yes it is blackmail as well as defamation.

      Thanks for your reply.  Yes he is a Bachelor.

His family now looking an alliance for him.

The query of Mr. kavksatyanarayana has no meaning. This is a clear case of intimidation through blackmail. The Whatsap is clear evidence. There may be sections in the new replacement of IPC against this. You can approach the police and a criminal lawyer and take action.

your brother's brother in law is threatening your brother to expose him in public and spoil his name in the society if his sister is not accepting the divorce case he filed.

Ask your brother not to be scared about this, whatever he does is his personal affair in which the third party cannot interfere.

In fact he can use it against him with acriminal complaint for the acts of threat and defamation.

What do you mean by "Brother's brother-in-law i.e. sister's husband"? Is he not your brother-in-law as well!

             Ofcourse he is my brother in law too.

But the Brother is not my own brother, he is my cousin.

Your explanation is less than satisfactory, esp. in the light of your earlier queries as seen from your profile.  You have been in the habit posting various relating divorce and RCR under the pretext of your own problems or that of your son, friend or relative etc. 

Prima facie, you are, by posting such riddles, trying to have some fun or setting question paper or may be both.

I like to say that the queries I made in this platform are real life queries of my relatives, son and friends.   

 I never tried to have some fun.
