Bond and service

Hi.. my husband working in a pvt software concern in chennai. strength of the concern reduced as 10 from 80. Employer not treating well like no increments for more than a year, performance incentive amount not given properly, no carrier growth, using bad words to scold employees in front of others without consider about their experience and age, giving lots of mental pressure. If an employee holds an offer then not relieving on time. threaten and  got bond from employees. Salary pending and more issues in this concern. don't know how to handle this guys with poor employees. Totally 5 to 6 employees suffered a lot. Please provide a good solution.  Totally the employer trying to collapse all those future.

First thing first: Consult and engage an able Labor Law Consultant ASAP.

1. Record irrefutable evidence (audio/visual/witnessed/minuted) of all that you have posted e.g. rudeness,rowdiness, non payment of wages etc...................Write gentle represenations under proper acknowledgment on issues that you have posted to good offices of appointing authority,MD,Chairman and exhaust the inetrnal options..........................and prove that employer has committed breach of its won commitements and is unworthy of being employed with.

 

Demand salary slips of all months, payment of earned wages on fixed day, perfromance incentives etc..............in writng under proper acknowledgment....

 

2. The Bond is created in lieu of what?     .........say soem certified training from some certified institute etc?

 

Or the Bond is just to offer employment?

Bonded labor/bondage has long been abolished.

 

3. Firm up next venture ASAP. Don't give long rope to such unscruplous employer.

Appraise the next empoyer of all facts and mention these in reason for leaving and also that employer has not been relieving and issuing acknowledgment/acceptance of resignation, service certificate,relieving letter, FnF statement (and issues or may issue negative comments in BGV........................if it is true), and you can't provide these untiol or unless these are supplied to you and you should be absorbed on the strength of copy of resignation letter alone.

 

4. Obtain proof of assets of establishment and employer.

 

5. Are you member of any IT employees/ employee's/trade union?
