Builder not refunding money.

I booked a flat at Rajpura with M/s Parsvnath Developes limited in October 2008 and signed an agreement with them. They were supposed to hand over the flat within 3 years else Rs 5/sqft fine would be given.

More than 4 years have passed and I went to get my monet back as there is no sign of completion nor they are paying me any compensation for delay. As I am in urgent need to buy a flat; I requested them to deduct earnest money and return me the rest of money to me; as per agreement terms. They are not even acknowledging myletters and not giving  any satisfactory reply.

Can I file a civil case against such a big company which is cheating gullible persons like me? And what are my chances?

Hello,

You can file case in consumer court for deficiency of service and you can claim compensation for harassing you........... This will help you for speedy remedy for your problem..

Yes you can file the case in consumer court.
