Builder problem

i booked a flat in ahmedabad. i have given 400000 as initial booking amount as it was demanded by builder without showing any documents perior to booking flat i informed builder that i will take my departmental loan not from the bank. so to get loan i have given him a list of documents which are required to get the loan from department. 

In the document list i needed Title clearance for the property. Builder has given some documents

In which i have found two things

1 land is not in the name of builder. it is the name of company promoter.

2 however sale to agreement is singed between me and company.

3.town ship is developed by the company however they didnt have title clearance in company name

4.So i discussed this matter my civil lawyer. he told me that agreement should be done between the land owner and me. not between company and me

5. In sale to agreement it is also not mentioned whether company belong to promoter or not. company people just told us that she is promotor.

However they are saying that this will take two months more to get title clearance in company name. the file in process. and forcing me to pay money and harrassing mentally. however i have already cleared perior to booking that i required loan my department for the payment.

now they are forcing me to take loan from banks.

Now i Have two question

Can bank issue loan without proper title clearance to the builder 

what can i do under these situation. i dont have money to give them.

Builder (Company )is one the best builder and powerful builder in ahmedabad.

Title is not in the name of the  company  , title clearance is not in the name of the company how can you pay further amount to company? you better join all other flat purchasers and file criminal case against the company.
