Dear Experts,
I had gifted my only residential property to my eldest son through Permanent Lok Adalat in 2006. My son mortagaged the same & took loan.
My youngest son challanged the Permanent Lok Adalat degree in Hon'ble High Court which after hearing all concerned quashed the permanent Lok Adalat Decree & restored the residential house to me in 2015 and Tehsildar restored the property in records to me as per Hon'ble HC order.
Now, the DRT on a ex-parte order has put the property to auction although I have lodged objection with RO (DRT) who has kept in further hearing on 25th April 2016.
My question is
a) Can DRT ignore Hon'ble HC order?
b) Can property restored to me by Hon'ble HC & Tehsildar be sold by DRT and buyer given the rightful title by DRT?
c) Will DRT not committing impropriety by giving advertisement in newspaper even after our learned advocate has in writing brought the facts into notice of Bank & DRT? Is it not a contempt of Hon'ble HC?
d) My eldest son was always ready to pay to Bank the balance amount but Bank wanted some civil cases lodged by third party to be resolved first & hence Rs 295 lacs became Rs 700 lacs as Hon'ble HC & Hon'ble SC took time to quash & settle those cases. My son (who is settled abroad) is ready to pay principal amount anytime.
