Can police provide the bail

hi,

if lower court issued the bailable warrant ..can police IO give the bail in case of 498A???

For a bailable  warrant issued by the court, only the court can grant bail and not police

no, police can not grant bail till the court give direction to police

agree with above expert's .......


for any cognizable offence the bail should be given by session court and not from police station.

S. 498-A is a non-bailable offence and only court can give bail.  but when the case is going on and on any occasion, if the accused does not present in the court on the date of hearing, the court may issue 'bailable warrants' and if that is so, the police can give bail to the accused after accepting the surety amount fixed by the court for his appearance on the next date of hearing.
