Title of extra land and construction there on

Builder is providing total land as 1680 per in agreement written as "Plot No. 1 Having area 152.64 Sq M, along with
an extra land area of 3.49 sq mtr (37.55 Sq.ft.) Total Plot Area actually available at
site is 156.13 Sq M (1680.00 Sq Ft) It is pertinent to mention that the allottee shall
have to obtain separate building permission from the concerned department, if they
choose to carry any development a construction work on this extra 37.55 sq ft."

Also in sale consideration it is written as " The Total Price for the Plot No.1 is Rs.______"

 

Question 1: Am i Entitled to get owner of Extra Land"?

Question 2: Can i get permission for construction on this extra land.

What is the agreement conditions in this regard?

As per TNCP Approval area of plot is 152.64 sq m but there is extra land 0.5'*70 is available. Actual dimension of area available at site is 24*70. Builder is not mentioning actual dimension of plot in agreement. 

 

kindly let me know what details required as i am dont know about legal aspects.

The posting is short of material facts. Limited facts suggests that the property referred is an apartment and issue is related to proportionate are of land in common enjoyment. Unless the material facts are disclosed, it is impossible that there could be any meaningful suggestion.
