Can we take any defence on the grounds of non joinder?

Plaintiff filed an ejectment suit under transfer of property act 106 against a partnership firm on 2009. One of the partner was expired on 2008, having a wife ,a son, and a daughter. In this ejectment suit, plaintiff included the expired partner's wife and son ,but not his daughter. Still the daughter is a non joinder in this case. Can we take any defence on the grounds of non joinder?

I am also one of the defendants in this case.

Such a defence is not permissible inasmuch as Order 33 Rule - 1 of CPC says that a partners can be sued in the name of the partnership firm only. therefore, non inclusion of the daughter as a party cannot be a ground to challenge the maintaianability of the suit on the ground of non-joinder of a party.

such a  defence is permissible if the   adjudication of the  title of the property is  involved, if  any  left out  party  necessarily indispasable  party  like  the one on hand  can  frustrate the  decree  therefore   no  decree could  be  passed  for  want  of  joinig  such  a  party ,  the  rule  of   filing   suit  in name  of  the partnership  is  an  enabling  provision  and  is  only  exception  but  it is operative  so  long  as  all the partners  are  living   , if in any  case  any  of  the partner  dies  then  his  heirs  are  required  to   be joined  as  parties  to  the  suit  ,  in  view  of  substative provision  of  s,45 of  the indian  contract  act ,  it is  not  clear    from the  posted  querry  as  to  whether  the  suit is  on  behalf  of  a  partnership  or  not , please  make  amend  accordingly

I  withdraw my  earlier reply  since  it  was given  under  supposed  belief that  the  suite  was  filed  by  the partnership  firm  and  one  of  the  partner  was  dead ,  .thanks
