Cancellation of e-tickets in case of trains cancelled

Hi All,

I have booked E-ticket on  25-06-2015 for GT express travelling from vijayawada to Chennai. Due to some reason train got cancelled so after 3 days they refunded the fare amount (excluding sevice tax). What about the service tax deducted by the irctc and Corresponding bank? When i spoke to irctc customer care they mentioned that they wont be refund the service tax, As it is a public service they have to provide alternative when it got cancelled atleast they are not refunding the service tax? For this reason shall i able to  file a case against IRCTC? 

Note: In my case service tax is a small amount if we consider all the passengers who booked the same train it will be huge amount.
