capital gains in rectification deed

If I sign rectification deed with owner of land of 30 years old property without consideration will capital gains tax to be paid

I am one of the owners of  30 years old apartments in Chennai 

When the flats were sold in 1983 / 84 there was a shortfall of 1000 Sq ft of uds  Now we that  retained  uds  for redevelopment Land owner is willing to convey the retained uds to flat owners 

1)Is rectification deed  without consideration is permisspelled to  1st  & 2nd  purchasers 

2) Will the owner of land have to pay capital gains tax for this  old  genuine  conveyance

It would be better to consult  a local prudent chartered accountant for your query on taxation.

To knowledge, in the absence of any consideration,  the transaction need invite not any capital gains tax. Anyhow, better suggestion could be from a professional tax consultant.

Whether rectification deed is applicable for conveying retained uds to 1st  & 2nd  purchasers from the owner of the land
