case instituted otherwise than on police report

This is case instituted otherwise than on police complaint, triable by court of sessions, magistrate taken on file as PRC, i.e., primary register case, the case has not committed sofare accused nbw pending, now the complainant want to withdraw the complaint , is it possible for magistrate to accept the withdrawal by the complainant at this stage.

IF THE CASE IS PRIVATE COMPLAINT IT CAN BE WITHDRWAN WITH THE PRMISSION OF COURT.

Urs is private complaint, only after the sworn statement summons will be issued, in your case nbw is issued so ur sworn statement is over. U can withdrawn the complaint by filing a memo
