Case law required

it is a settled law that it is not necessary to write or mention the provision of law or the section or order in application made before the court of law, what is necessary is the contents and prayer of the application.

please if any member of this forum has a ruling on this point kindly let me know the citation

or if any member can provide me the copy of ILR (2002) 3 kant 3591 OR (2002) 3 Bank cas 46 it will help me.

Dear Madam Thanks for the information but the problem is that i dont have parties name neither do i have the date of judgement. i noted the citation fron AIR manual which only specifies the publisher ie ILR, year vol and page no.

with this limited information im unable to search it from www.judis.nic.in

I shall be greatfull if you could do it for me.

No citation needed for basic matters.

However if mention law/ provision  it helps you to explain better.

Writing facts in the plain is usual . But it is necessary to plead limitation law in plaint

Mr. Virupanagouda

at last I got the required case law after searching all case laws of the year 2002 of Karnataka HC one by one on indiankanoon  as suggested by you.

sometimes even the smallest n very simple thing becomes a challenge for us. thats what practicing law is.

Regards
