If someone commits a fraud against me and files a civil suit against me. During the pendency of that civil suit - Can the opposite party discover cctv footage from my property which has no relevance with the dispute ?
*The surveillance covers a commercial space (my shop) and the image capturing technology is directed within the private setting of the property.
Can such documents (cctv footage) could be obtained by the opposite side under Order 11 Rule 12-14 CPC. Considering the discovery has no relevance with the dispute and is misleading perse ?
If that's the case, can any person initiate a false suit against me and apply for discovery of such documents (cctv footage)?
*please note that cctv camera installed in the property is for my own personal safety.
Can any person obtain such data under Order 11 Rule 12-14 CPC ?
Hello,
There is a provision for discovery for the document in CPC and every person has the right to file an application on that basis. You can oppose the application as per your grounds of the case stated above.
