CHANGE OF DESIGNATION OF DISCIPLINARY AUTHORITY IN DEPARTMENTAL ENQUIRIES

In nationalised banks as per Officer's Service Regulations,for Scale II & III officers only a Deputy General Manager can be the disciplinary authority in departmental enquiries and in a particular case the  DA/DGM has got promoted as General Manager before the passing of final order in that particular departmental enquiry – In the final order DA has signed as General Manager – Whether this order can be challenged / or held invalid? In the same enquiry there had been change of DA once before during the enquiry period.

on the basis of change of DA or signing of final order as General manager one can't challenge in court. it all depends upon whether principles of natural justice are followed or not. i.e. no biasedness by the DA or GM and you were given proper chances to defend yourself properly in the enquiry.
irrespect of change of DA etc you have every right to challenge in court after your plea before appellate authority was a failure.
