Suppose a magistrate issued a bailable warrant against the accused in a non bailable case and he has given security thereby fulfill the requirement under section 73 subsection 1 .Whether he will be released by the court on receiving the security?

He shall certainly be released if the court has issued bailable warrant against him and he has furnished the security mentioned in section 73 (1) or 71 of CrPC, and he has already furnished bail bonds. In case he has been issued bailable warrants for the first time and he was not already on bail, then he has to seek bail from the court concerned under section 436 or 437 as the case may.
