Clarification regarding desertion clause

Dear Experts,

My wife absconded from my home 2 years ago i.e on 09-NOV-2012 and NEVER returned back. However, she was sending some SMS messages on my mobile and we met at a Park in Hyderabad couple of times to discuss the issues. However, we couldn't come to consensus. And now it is clear that we both can't live together and hence I am planning to file case under section 13(1) (I-a) (I-b) on the grounds of cruelty and desertion.

Since we met couple of times in the park. and also we had some conversations exchanged via Facebook and mobile, is the desertion clause invalid? We didn't live together for a continuous period of 2 years now and there is no cohabitation for more than 2 years now?

Please clarify if desertion ground will be applicable in my case?

Regards,

Sastry

Opt for mutual consent divorce, don't complicate things unless required. Time is money, find out what your wife wants for mutual seperation , do you have a child ?
