Clearification for dispute

Respected Legal Experts,

I have gone through the forum and read few articles for my situation i am getting contradictory info so help me with all possible advice below is the situation

Mr.A(Great Grand Father) had 5 children 3 girls and 2 boys, all born pre-independence and all passed away before 2002 Mr.A made a Gift Deed and passed on his own earned assets to both sons

all the 5 got married the 3 sisters and 2 son

now the 2 sons are B and C,

B had 2 sons and C died without issues, all the sisters in this case have their lineage.

B with sons died and since it joint family C got to be the executor and every thing was handeld solely by him 

C passed without legal Heir's and both widowed passed as well

 

Now my question is in this scenario can the daughters son's have any claim on this property

and Mr.B's Son who also have passed away can their heirs claim this

Kindly Clearify since the people passed away before the 2005 amendment

You hadn't mentioned in which favour /person the gift deed was made by your great grand father , when you will clear it only then the solution come out .

The gift deed was given to both sons Mr.b and Mr.c

A also that all the parties are hindu

as per your input B and C were the owner of the gifted property given by A to them , C had died issueless wife and mother of C also died , now The legal heir of the C which can claim share in the property of C comes from heirs in class II i.e. in between C's sister if sisters died then in between brothers son , sisters son , brothers daughter , sisters daughter, in this your case the son's of C's brother had died now the remaining legal heirs are sisters son , brothers daughter and sisters daughter , the property of C will distributed in 1/3 equal share among the above said 3 legal heirs of C .

Could you kindly explain how the sisters can claim on the property since all are as completed before 2005 amendment under which law would this be reviewed 1956 , 2005 or law prevailing before 1956

You have posted that:

Mr.A made a Gift Deed and passed on his own earned assets to both sons”

The owner has gifted his self acquired assets to person (sons).

If it is by a valid gift deed in the life time of the Owner then sisters and their legal heir have no claim.

The legal heir of the sons can stake their claim if the sons have died without leaving a WILL.

 

It shall be appropriate to show all docs and record in person, to a lawyer specializing in such matters.

 

The lawyer that has analyzed all docs and inputs can advise you the best.

Mere bhai ne apni ek shop  double story ek parson ko bina kisi rent agreement ke mokhik Rs. 10000/- per month me is sart pe di ki jab nujhe chahiyegi tab ek mahine pahle bata dunga aur khali karni padegi. aur shop par apna name nahi likhega. electric conation bhai ke name se laga hua tha. 2010 me bhai ki death ho gayi. bai ke teen bachhe hai 24-25 saal ka bada ladka 100/- mantly disturb hai ladki 22-23 yr ki hai aur ek ladka 15-16 yrs ka 10-2 me hai.

jan2014 me shop me agyat karn se fire ho gayi aur sara maal jal gaya va shop building ka bhi bahut nuksaan hua. bad me haumne shop ko thik karwaya abhi kam baki tha. pahle shop me upar jane ka rasta anda tha jo ab thik karwai tab alag se kar diya aur niche ka tatha uppar ka prosan alag ho gaya.

electirc mitter bhi fire me jal gaya tha. ab new conection ki bat hui to pata chala ki bhai ke name se mitter gayab hai aur jisko shop de rakhi thi usne apne name se mitter laga rakha hai jan.2012 se. ab hamne shop par apna lock kar diya tha . aur usko shop dene se mana kar diya. lekin bad me ek raat  usne raat ka fayda utha kar apne kuch admiyo ke sath milkar shop ka lock tod kar shop par apna kabja kar liya aur saman aur firniture fir karwa liya ratorat. aur sbha shop khl kar baith gaya. jab hume pata chal to hum gaye to usne kaha ki mai kirayedar hun tum mujhe nahi nikal sakte. aur mujhe hi deni padegi.

ab aap bataye ki hum kya kare? court me jaye ya uske sath rent agreement kare? woh agreement karne keliye tyra hai Rs.8000/- per month ke liye. aur electric mitter meri bhabhi ke name se lagane ko bhi tyar hai. uppar ka porson bhabhi ke pas rahega woh niche ki shop ka agree ment karne ke liye kah raha hai.

aap bataye ki kya ab agreement karna chahiye? kitne me aur kitne time ke liye karna chahiye?

kya agreement ke khatam hone ke bad uska hi kabja bana rahega . khali nahi karne ki surat me hum kya kar sakte hai ? please help him. ek wodow aur uske handicap bachhe ki koi help ho sakti hai shop ke na milne par? shop narnaul me haryana me hai.
